Please read our term and conditions carefully. When placing a bulk content or small order with us, you agree to be bound by all terms and conditions of this agreement.

Copyright

Our policies are designed to protect both our clients and ourselves and conform to international copyright law. Publishing, sale and re-distribution rights reside entirely with the copyright owner. Once you have paid the full fee for the project, the copyright is yours entirely. Until then, we retain it and all rights for use. New projects may be begun once all past projects are paid in full. This applies to both bulk content and limited orders.

Parties

These Terms and Conditions (“Contract”, “Agreement”) constitute the agreement between MBiz (“We,” “Us,” the “Company”), a bulk content writing service, and you (“You,” “Customer”).

Services

MBiz offers content services, ranging from bulk orders to small projects. Content is delivered in the form of written documents (“Project”, “Order”) provided to the Customer. MBiz will deliver the Project in accordance with order requirements and within the timeline stated in the order requirements. Upon mutual agreement with the Customer, MBiz reserves the right to change delivery time.

Conditions of Service

“Order Requirements” include all information specified when posting the Order. The Customer may make any additions or alterations within three hours of creating an urgent Project (a Project with delivery specified within 24-48 hours) and within 20 hours of creating a non-urgent Project (more than 48 hour delivery) unless other agreement is obtained from MBiz. After the above mentioned time, the Company has reserves the right to consider all updates and materials as “Additional Requests” and include them in Order details at its discretion. MBiz reserves the right to demand additional charges for Additional Requests regarding the quantity of extra work required.

MBiz guarantees that the Project will be completed by writers with relevant expertise and in accordance with the Order Requirements. However, the Company does not guarantee increases in web site or blog visits, increases in revenue or other business-related results of the Customer.

The Customer acknowledges that they completely understand that the Company’s obligations are limited to producing the required Content, in accordance with Order Requirements and delivered by the agreed-upon time.

The Customer further acknowledges and agrees that they bear full responsibility for business results and for ensuring that the delivered Content meets their expectations.

Revision, Refund and Cancellation

MBiz will accept revision requests from the Customer only within 10 days of Project submission. After the expiration of this period, MBiz will consider the Project to be closed and will treat all additional requests as new projects. The 10-day review period is renewed after each Project submission or revision.

MBiz will provide up to two revisions of Project Content free of charge and within the shortest possible time if the Customer determines that said Content fails to comply with Order Requirements. If the Customer requests Content revision according to new specifications not mentioned in the Order Requirements, MBiz will consider this request as a new Project. The Company has the right to demand additional fees for Additional Revision Requests, in accordance with the volume of additional work required, or to decline such Requests if the Company determines that there is no possibility of completion.

Refund Policy

MBiz will offer refund of full or partial order cost in these cases:

·         If the Project is seven hours past the deadline for urgent Projects (24-48 hour delivery) or 24 hours past the deadline for non-urgent Projects (greater than 48 hour delivery). This condition does not apply to deadline extensions agreed to previously by the Company and the Customer.

·         If the Project fails to comply with Project requirements and the Company fails to deliver proper revisions within 12 hours for urgent Projects and 36 hours for non-urgent Projects. The condition does not apply in cases of mutual prior consent between the two Parties regarding revision deadlines, nor does it apply to cases of minor deviation from the original Order Requirements.

·         If the Client detected plagiarized text in the Project Content. A copy of a report from software designed to detect plagiarism is necessary before a refund can be considered. In order to qualify for a partial refund, the amount of plagiarized text should be no less than 10% of entire Content volume. In order to qualify for a full refund, the amount of plagiarized text should 25% or more of the entire Content volume. Text placed inside quotation marks and properly cited does not qualify as plagiarism. Nor does any bibliographical description of Content sources on a Bibliography or, Works Cited page.

Requests for refunds are considered only within 10 days of submission of the Project or Project Revision. If the Customer fails to request revision or refund within the 10-day period, the Project is considered Closed and no refunds will be issued.

The Customer is not entitled to any refunds based on business results or damages of any kind arising in connection with or resulting from the use of our services.

MBiz will cancel an Order under the following circumstances:

•          Upon Customer request within three hours after creating the Order for an urgent Project or within 12 hours after creation of an order for a non-urgent Project.
•          Upon mutual agreement by both Parties if an MBiz writer has not initiated work on the Project.
•      If a considerable amount of work has been accomplished, Order cancellation is possible only with a partial refund of Order costs.

Fees and Payments

The Customer agrees to pay the Order Fee to MBiz  in accordance with all Project details. Payment of 30 per cent of the Order fee will be made immediately upon creation of the Order. Final payment will be made at Order completion. With the agreement of both Parties, the remainder may be due at the accomplishment of mutually agreed-upon milestones.

Limitation of Liability:

You agree to release and hold the Company and its employees, officers, directors, shareholders, agents, representatives, affiliates, subsidiaries, advertising, promotion and fulfillment agencies, any third-party providers or sources of information or data and legal advisers (the “Company’s Affiliates”) harmless from any and all losses, damages, rights, claims, and actions of any kind arising from or related to the Projects, including but not limited to: (a) telephone, electronic, hardware or software, network, Internet, email, or computer malfunctions, failures or difficulties of any kind; (b) failed, incomplete, garbled or delayed computer transmissions; (c) any condition caused by events beyond the control of the Company that may cause the Project to be delayed, disrupted, or corrupted; (d) any injuries, losses or damages of any kind arising in connection with or as a result of utilizing our services; or (e) any printing or typographical errors in any materials associated with our services. In addition, you agree to defend, indemnify, and hold the Company and Company’s Affiliates harmless from any claim, suit or demand, including attorney’s fees, made by a third party due to or arising out of your utilizing of our services, your violation or breach of this Agreement, your violation of any rights of a third party, or any other act or omission by you.  

IN NO EVENT SHALL THE COMPANY BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OF CONTENT PROVIDED BY MBIZ, use of its website or blog, OR ANY INFORMATION PROVIDED.
